These Terms and Conditions ("Agreement") govern your access to and use of the digitalproduct marketed as "The Holly Hatch Method," (“the Product”) provided by Holly Hatch Capital Inc. or its licensors (“Company”, "we," "us," or "our").
By accessing or using the Product, you agree to be bound by this Agreement. If you do not agree with these terms, you are not entitled to use the Product.
The Product, including but not limited to its content, design, logos, trademarks, and any associated materials, are protected by intellectual property laws and are the exclusiveproperty of Holly Hatch Capital Inc. or its licensors. You acknowledge that you have no proprietary or ownership rights in the Product.
You must not copy, reproduce, distribute, modify, create derivative works, decompile, reverse engineer, rent, lease, sublicense, or otherwise exploit the Product except as expressly permitted in writing by the Company.
No Warranty / Limitation of Liability
The Product is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to this Agreement or the Product is limited to the amount you paid for the Product. In no event will we be liable for indirect, incidental, special,
consequential or punitive damages.
Indemnification:
You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or in connection with your use of the Product, your breach of this Agreement, or your infringement of any third party’s rights.
Jurisdiction:
Any disputes arising from or relating to this Agreement shall be resolved in accordance with the laws of the Province of British Columbia and the Dominion of Canada. Any action arising must be filed and heard in a Court of competent jurisdiction in Victoria, British Columbia, and you agree to submit to the jurisdiction of such courts. To the maximum extent permitted by law, you waive the right to participate in class actions
against us.
We may terminate or suspend your license to use the Product at any time for breach of this Agreement or for operational reasons. Upon termination, you must cease all use of the Product and delete or destroy any copies in your possession or control.
We may amend this Agreement at any time by posting the revised Agreement on our website. Your continued use of the Product after the posting of any changes constitutes your acceptance of such changes. It is your responsibility to review the website and the agreement regularly.
